Nursing homes are required by law, both locally and federally, to establish a plan of care. The laws require that the nursing home maintain sufficient staff to provide all the care on their plan. So many nursing homes are privately owned. As a result, they are frequently understaffed. Residents suffer neglect as a result of the understaffing.
Neglect means “the negligent failure of any person having the care of custody of an elder or a dependent adult to exercise that degree of care which a reasonable person in a like position would exercise.”
Some examples of neglect include:
- Failure of the provider to help a resident with personal hygiene:
- Failure to provide food, clothing or shelter
- Failure to administer proper medical care for the resident’s physical and mental needs
- Failure to prevent dehydration and malnutrition
